Mainstream Media Silent on Landmark Ruling Declaring PCR Test Unreliable for COVID-19

In a groundbreaking legal decision, a Portuguese court has declared COVID-19 PCR tests unreliable, potentially up to 97% inaccurate.

This verdict, however, has been conspicuously ignored by mainstream media.

Portuguese Case: Proc. 1783/20.7T8PDL.L1
Tribunal Judicial da Comarca dos Açores - Juízo de Instrução Criminal de Ponta Delgada.

The case involved four German tourists who were quarantined in Portugal after one tested positive for COVID-19. The Portuguese judges upheld a lower court's decision, ruling the quarantine unlawful due to the questionable reliability of PCR tests.

On November 11, the Lisbon Appeal Court delivered this verdict following an appeal from the Azores Regional Health Authority against a habeas corpus petition filed by the tourists. The ruling found that the authority had violated both Portuguese and international law by enforcing the quarantine without a medical diagnosis.

The court's 34-page ruling criticised the PCR test's ability to definitively determine COVID-19 infection. The judges highlighted two main issues: the test's reliability varies with the number of cycles used, and it is influenced by the viral load present in the sample. This means there are significant uncertainties surrounding PCR test results.

Experts have long debated the credibility of PCR tests, particularly the cycle threshold, which in most US and European labs ranges between 35-40 cycles. Some experts argue that this range is too high and suggest a more accurate range of 25-30 cycles. Studies have shown that at a cycle threshold of 35 or above, the chance of a false positive could be as high as 97%.

The Portuguese court also referred to a study by leading European and world specialists, published by Oxford Academic, which found that the probability of a false positive result is extremely high when the cycle threshold is 35 or higher.

Despite the profound implications of this ruling, the mainstream media has largely ignored it. This oversight is surprising given Portugal's standing as an EU country with a credible legal system. Furthermore, other nations are also questioning widespread COVID-19 testing practices. For example, Finland’s national health authority has disputed the WHO's recommendation for mass testing, and some Southeast Asian countries are delaying vaccine orders due to resource concerns.

The reliability of PCR testing underpins the global response to COVID-19, affecting case numbers, infection rates, and subsequent restrictions. As evidence mounts questioning the foundation of these tests, it becomes crucial to re-evaluate our approach to managing the pandemic and unlawful actions of the governments who manipulated the people through fear, breaching our Constitutional Human Rights.

We have been lied to. Unlawfully detained, harmed, injured and caused grave loss to millions of innocent people. Our governments have broken the Rule of Law.

“that at a cycle threshold (ct) of 25, about 70% of samples remained positive in cell culture (i.e. were infectious); at a ct of 30, 20% of samples remained positive; at a ct of 35, 3% of samples remained positive; and at a ct above 35, no sample remained positive (infectious) in cell culture (see diagram). This means that if a person gets a “positive” PCR test result at a cycle threshold of 35 or higher (as applied in most US labs and many European labs), the chance that the person is infectious is less than 3%. The chance
that the person received a “false positive” result is 97% or higher".
